Every prescription is subject to the independent professional judgment of a licensed pharmacist. A pharmacist may request clarification, require additional information, contact the prescriber, delay preparation, recommend that the prescriber consider an alternative, decline to compound or dispense, or refer the prescription elsewhere when appropriate.

These decisions may be based on patient safety, clinical appropriateness, prescription validity, applicable law, professional standards, ingredient availability, stability, compatibility, delivery requirements, or other considerations within the pharmacist’s professional judgment.

Submission of a prescription or medication request does not obligate Nationwide Compounding to prepare, dispense, refill, transfer, ship, or otherwise provide the requested medication.

Prescriptions for controlled substances may be subject to additional identity verification, prescriber confirmation, prescription-monitoring-program review, documentation requirements, geographic restrictions, refill limitations, or other requirements permitted or required by law. Submission of a controlled-substance prescription does not guarantee that it will be filled.

No information on the Site constitutes an offer to sell or dispense a prescription medication without satisfaction of all applicable legal, professional, clinical, payment, and operational requirements.

Nationwide Compounding Rx® operates as a 503A state-licensed pharmacy and provides pharmacy services only where legally authorized.

When applicable, Nationwide Compounding prepares patient-specific compounded medications pursuant to valid prescriptions or medication orders and in accordance with applicable federal and state law.

Compounded medications are not approved by the United States Food and Drug Administration (“FDA”). The FDA does not review compounded medications for safety, effectiveness, or quality before they are marketed.

Compounded medications are not the same as FDA-approved brand-name or generic medications. A healthcare provider may prescribe a compounded medication when the provider determines that an available FDA-approved medication does not adequately meet an individual patient’s clinical needs or when compounding is otherwise legally permitted.

Information on the Site concerning compounded medications, ingredients, strengths, dosage forms, routes of administration, or therapeutic uses is educational only. It does not guarantee that a particular compounded medication:

• Is appropriate for an individual patient;

Medication or formulation availability may change due to ingredient shortages, backorders, manufacturer discontinuations, supplier limitations, recalls, testing or quality concerns, regulatory actions, changes in law, or other circumstances outside Nationwide Compounding’s reasonable control.

Nationwide Compounding does not guarantee the continued availability of any ingredient, formulation, strength, dosage form, flavor, package size, or pharmacy service.

Patients, caregivers, parents, legal guardians, and authorized representatives agree to:

• Provide complete, accurate, and current information;
• Promptly update information that is inaccurate or has changed;
• Provide truthful information regarding the patient’s identity, location, health conditions, allergies, sensitivities, medications, and prescribing provider when requested;
• Review the medication label and accompanying instructions before use;
• Confirm that the patient name, medication, strength, dosage form, and directions appear consistent with the expected prescription;
• Use medications only as directed by the prescribing provider, pharmacist, and prescription label;
• Store, refrigerate, handle, measure, and administer medications as directed;
• Use appropriate measuring and administration devices when applicable;
• Keep medications secure and out of the reach of children, pets, and unauthorized individuals;
• Use medications only for the patient for whom they were prescribed;
• Never sell, give away, transfer, distribute, divert, or share prescription medication;
• Contact the prescribing provider or pharmacist before changing or discontinuing treatment; and
• Properly dispose of unused, expired, recalled, or discontinued medication.

Patients and caregivers should promptly notify Nationwide Compounding of suspected dispensing or labeling errors, unexpected reactions, adverse events, damaged products, suspected contamination, visible particles, unusual appearance, opened or leaking packaging, storage concerns, temperature concerns, or any other question regarding medication quality or integrity.

Do not use a medication if you believe it was dispensed for the wrong patient, contains incorrect information, appears damaged or contaminated, has been tampered with, or may have been stored improperly. Contact Nationwide Compounding promptly for instructions.

For serious reactions or urgent medical concerns, contact the prescribing provider or seek emergency medical care as appropriate.

Healthcare providers and their authorized representatives who use the Site represent that:

• They hold all licenses, registrations, credentials, and prescribing authority required for their professional activities;
• Information and documentation they submit are accurate, complete, and not misleading;
• They are authorized to prescribe or order the requested medication in the applicable jurisdiction;
• Each prescription or medication order is issued for a legitimate medical purpose within the usual course of professional practice;
• They have established any provider-patient relationship required by law;
• They have evaluated the patient as required by applicable law and professional standards;
• They will comply with applicable prescribing, telehealth, patient-record, privacy, and controlled-substance requirements;
• They will conduct clinically appropriate follow-up and patient monitoring;
• They will communicate material prescription changes or discontinuations to the patient and pharmacy; and
• They have obtained any patient authorization or consent necessary to transmit patient information to Nationwide Compounding.

The prescribing provider remains responsible for patient evaluation, diagnosis, medical necessity, informed consent, treatment selection, dosing decisions, prescribing, and ongoing clinical monitoring.

Nationwide Compounding may receive prescriptions from independent healthcare providers, including providers who evaluate patients through telehealth. Unless expressly stated in a separate written agreement, Nationwide Compounding does not employ, supervise, control, or direct an outside provider’s clinical practice and is not responsible for that provider’s clinical decisions, representations, billing practices, or legal compliance.

Nationwide Compounding may verify provider credentials and prescribing authority and may request supporting documentation when permitted or required by law.

Products, formulations, services, pickup options, delivery options, and shipping availability may vary based on:

• Patient and prescriber location;
• Nationwide Compounding’s licenses and registrations;
• Applicable federal and state law;
• Prescription requirements;
• Controlled-substance requirements;
• Ingredient availability;
• Clinical appropriateness;
• Medication stability and storage requirements;

• Pharmacist review; and
• Other legal, quality, safety, or operational considerations.

Certain medications, ingredients, strengths, dosage forms, compounded preparations, controlled substances, or pharmacy services may not be available in every jurisdiction.

• Insurance coverage is not guaranteed;
• Nationwide Compounding does not participate with any insurance plans;
• All prescriptions are cash; and
• An estimated price is not a guarantee of final cost, coverage, or reimbursement.

Nationwide Compounding is a cash-pay pharmacy and does not bill or submit claims to commercial insurance, Medicare, Medicaid, or other third-party payers. Payment is due directly from the patient or authorized purchaser before the medication is prepared or dispensed, unless otherwise agreed in writing.

Upon request, Nationwide Compounding may provide an itemized receipt that a patient may submit to an insurance plan or other benefit administrator for possible out-of-network reimbursement. Nationwide Compounding does not guarantee coverage or reimbursement, and the patient is solely responsible for determining whether any portion of the cost may be reimbursed.

Because compounded medications may be prepared specifically for an individual patient and may not be reusable or resalable, cancellation, return, and refund options may be limited once preparation has begun or a medication has been dispensed.

Contact Nationwide Compounding promptly if you need to cancel or modify an order. A requested cancellation or modification is not effective until confirmed by Nationwide Compounding.

Nothing in these Terms limits any cancellation, refund, replacement, or other right that cannot legally be waived.

Medications may be available for pickup or shipping only where legally permitted and operationally available.

Preparation, pickup, and delivery timeframes are estimates and are not guaranteed. Delays may occur because of prescription verification, provider response times, clinical review, ingredient availability, quality testing, payment issues, weather, carrier interruptions, holidays, regulatory requirements, or other circumstances outside Nationwide Compounding’s reasonable control.

You are responsible for:

• Providing a complete and accurate delivery address;
• Confirming that the address is appropriate for receiving prescription medication;
• Notifying Nationwide Compounding of address changes before shipment;
• Monitoring delivery and tracking communications;
• Ensuring that an authorized person is available to receive the package when required;
• Retrieving delivered medication promptly;
• Preventing theft or unauthorized access; and
• Following all storage, refrigeration, temperature, and handling instructions.

Do not ask a carrier to reroute, forward, redirect, or hold a medication shipment without first contacting Nationwide Compounding. A reroute or delay may expose the medication to conditions outside the intended delivery process.

Certain medications require refrigeration or protection from excessive heat or cold. Packaging, insulation, coolant, and temperature indicators are intended to support the delivery process but do not eliminate the recipient’s responsibility to retrieve and properly store the medication promptly after delivery.

A medication should not automatically be discarded solely because a coolant or ice pack is no longer frozen. Contact Nationwide Compounding for an individualized assessment if you have questions about temperature exposure or medication condition.

Once delivery has been completed to the address provided, the recipient is responsible for the medication’s security, storage, refrigeration, and handling unless otherwise required by law.

If tracking information indicates that a shipment has been delivered but you cannot locate it, contact Nationwide Compounding and the carrier promptly.

Contact Nationwide Compounding promptly if a shipment is delayed, damaged, opened, delivered to the wrong location, exposed to concerning conditions, or appears to have been tampered with.

Do not use a medication if you have concerns about its identity, labeling, contents, condition, temperature exposure, or integrity until you have spoken with a pharmacist.

Nationwide Compounding may investigate, quarantine, retrieve, replace, correct, or recall a medication when required by law or when quality, safety, or regulatory considerations warrant action. If you receive a recall or safety notice, follow the instructions provided.

By providing an email address, telephone number, or other contact information, you authorize Nationwide Compounding and its service providers to contact you regarding your inquiry, prescription, order, payment, account, refill, pickup, delivery, quality concern, safety notice, recall, or pharmacy services.

Communications may be sent by telephone, voicemail, email, text message, automated delivery notification, portal message, or another method you authorize. Message and data rates may apply.

Consent to receive marketing communications is not a condition of purchasing a product or receiving pharmacy services. Where required, marketing communications will be sent only with appropriate consent.

You may opt out of marketing text messages by replying “STOP” or following the instructions provided in the message. Opting out of marketing communications does not necessarily prevent Nationwide Compounding from sending transactional, treatment-related, safety-related, recall, prescription, account, delivery, or legally required communications when permitted by law.

If these Terms or the Privacy Policy conflict with the HIPAA Notice of Privacy Practices concerning protected health information, the HIPAA Notice of Privacy Practices will control.

Nothing in these Terms constitutes an authorization for the use or disclosure of protected health information when a separate written authorization is required by law.

Nothing in these Terms limits professional pharmacy obligations, liability for gross negligence or willful misconduct, violation of law, or any right, remedy, duty, or liability that cannot legally be limited or waived.

Some jurisdictions do not allow certain exclusions or limitations of liability. Accordingly, some limitations may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless Nationwide Compounding and its owners, officers, directors, employees, pharmacists, contractors, and service providers from third-party claims, liabilities, damages, judgments, and reasonable costs arising from:

• Your unlawful, fraudulent, or unauthorized use of the Site;
• Your material violation of these Terms;

This provision does not require a patient to indemnify Nationwide Compounding for Nationwide Compounding’s own professional negligence, gross negligence, willful misconduct, or violation of law.

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where federal law or the nonwaivable law of another jurisdiction applies.

Subject to applicable law, any legal action concerning the Site or these Terms must be brought in a state or federal court with jurisdiction in Maricopa County, Arizona.

You consent to the personal jurisdiction of those courts.

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect. The affected provision will be limited or modified to the minimum extent necessary to make it enforceable when legally permitted.

Failure by Nationwide Compounding to enforce a provision of these Terms does not waive the right to enforce it later.

Nothing in these Terms limits any consumer, patient, privacy, or statutory right that cannot legally be waived or restricts the authority of a governmental or regulatory agency.

Nationwide Compounding may revise these Terms periodically to reflect changes in the Site, pharmacy services, applicable law, technology, or business practices.

When these Terms are updated, the revised “Last Updated” date will appear at the top of the page. Changes become effective when posted unless otherwise stated.

Continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
